How Michelle Conquered Systemic Barriers

In a quiet rural landscape in Wisconsin, one woman's story reveals the intricate challenges faced by survivors of domestic violence who navigate complex legal systems and personal struggles. 

Michelle's journey is not just a personal narrative, but a testament to resilience, systemic barriers, and the transformative power of targeted legal support.

A Life Interrupted

At 26, Michelle's life had been marked by profound challenges that began in her teenage years. Married young to an older partner, she experienced domestic violence that would reshape her entire life's trajectory. Her husband's eventual arrest and imprisonment left her struggling to support two young children while facing the compounded challenges of trauma, limited education, and economic instability.

The systemic obstacles Michelle encountered were formidable. Without a high school diploma and battling PTSD and anxiety, she found herself in a precarious position. Her attempt to heal — entering a rehabilitation program in another state — required her to make the difficult decision to temporarily entrust her children to her in-laws.

Systemic Challenges and Resilience

What followed was a painful separation that exposed critical gaps in family support systems.  During the height of COVID-19 restrictions, the court made an important decision without meeting in person with Michelle, her children, or in-laws. They gave permanent guardianship of Michelle’s children to her in-laws.

She was effectively separated from her children.

Even when Michelle found stable housing and employment, her in-laws refused to return custody of her children. They also used threats to maintain control, blocked holiday visits, and restricted communication with her children.

This experience underscores a critical issue in family law: the vulnerability of parents with disabilities and those recovering from personal challenges. Michelle's story is not unique — it represents a broader pattern of systemic barriers that can perpetuate negative cycles.

The Power of Targeted Legal Support

A crucial turning point was when a local anti-domestic violence program directed Michelle to Disability Rights Wisconsin (DRW). By providing targeted legal representation, Disability Rights Wisconsin’s advocates helped her navigate the legal system.

Beyond legal assistance and advocacy, Disability Rights Wisconsin restored Michelle’s dignity and agency. They rebutted her in-laws’ many discriminatory arguments that challenged Michelle’s parental capabilities based on her disability. In the end, Disability Rights Wisconsin successfully terminated the guardianship, reuniting Michelle with her children.

A Path Forward

Today, Michelle is rewriting her narrative. Enrolled in a GED boot camp and pursuing certification as a nursing assistant, she is creating a stable future for herself and her children. Her journey represents more than personal recovery — it's a powerful example of how targeted support can break cycles of vulnerability.
